9. Termination

We may suspend or terminate your access to the Services for any reason, including but not limited to violation of these Terms, suspected fraudulent activity, or prolonged account inactivity.

Upon termination, your right to use the Services ceases immediately. Any licenses granted under this Agreement shall terminate, and you must delete any downloaded or stored copies of our software or content. Provisions that by their nature should survive termination (e.g., indemnification, limitation of liability) shall remain in effect.

10. Disclaimers

We strive to provide high-quality and reliable Services, but we do not guarantee that our Services will be error-free, uninterrupted, or fully secure. All Services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied.

To the maximum extent allowed under law, we disclaim all warranties, including but not limited to fitness for a particular purpose, merchantability, and non-infringement. Your use of the Services is at your own risk.

11. Limitation of Liability

To the fullest extent permitted by applicable law, Better App Information Technology LLC, its officers, directors, employees, or affiliates shall not be liable for:

  • Any indirect, incidental, punitive, special, or consequential damages;
  • Loss of profits, revenue, data, or goodwill;
  • Damages resulting from unauthorized access, use, or alteration of your data.

Our total liability arising from or relating to these Terms is limited to the total amount paid by you for the Services in the three (3) months prior to the claim.

12. Indemnification

You agree to defend, indemnify, and hold harmless Better App Information Technology LLC and its affiliates, partners, and personnel from and against any claims, liabilities, damages, losses, and expenses, including legal fees, arising out of:

  • Your use of or inability to use the Services;
  • Your User Content;
  • Your violation of these Terms or applicable law;
  • Any third-party claims related to your conduct or content.

This indemnity obligation will survive the termination of this Agreement.

13. Governing Law and Dispute Resolution

This Agreement is governed by and construed in accordance with the laws of the United Arab Emirates, specifically the laws of the Emirate of Dubai.

Any disputes arising from or related to this Agreement shall be subject to the exclusive jurisdiction of the courts of Dubai. We encourage users to contact us first to attempt a resolution before initiating formal legal proceedings.

14. Amendments

We may update or revise these Terms periodically. Changes will take effect upon posting on our website or within our applications. It is your responsibility to review these Terms regularly. Continued use of the Services constitutes acceptance of the updated Terms.

15. End User License Agreement (EULA)

By downloading, installing, or using our software applications, you agree to this EULA:

  • You are granted a limited, non-exclusive, non-transferable, revocable license to use the software on authorized devices;

16. Refund Policy

  • One-Time Purchases: Refunds may be issued for technical failures or accidental purchases, if requested within 7 days.

All refunds are issued at our discretion and processed through the original payment method.

3. User Policy

6. Account & Billing

This Account & Billing Policy ("Policy") describes the terms and conditions relating to account management, billing practices, refunds, and recurring subscriptions for mobile applications developed and distributed by Better App Information Technology LLC ("Company," "we," "our," or "us"), a company incorporated in Dubai, United Arab Emirates.

By creating an account, subscribing, or making in-app purchases within our mobile applications (the "Apps"), you ("User," "you," or "your") agree to comply with this Policy.

1. Account Creation and Management

  • Account Setup: To access premium or subscription features, you may be required to create an account within the App or via your App Store account.
  • Account Responsibility: You are responsible for all actions performed through your account, including maintaining confidentiality of login details.
  • Account Changes: You can update your account details and subscription preferences directly in your App Store account settings or within the App (where available).

2. Subscription and Recurring Billing

  • App Store Subscriptions: All paid subscriptions, including auto-renewable subscriptions, are managed by Apple App Store or Google Play Store, depending on your platform. We do not collect or store your payment details.
  • Recurring Billing: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
  • Charges: Payment will be charged to your App Store account upon confirmation of purchase. Renewal charges will be applied within 24 hours prior to the end of the subscription period.

3. Subscription Management and Cancellation

  • Cancellation: You can manage or cancel subscriptions at any time in your App Store account settings. Deleting the App does not automatically cancel an active subscription.
  • Downgrades or Upgrades: Changes to subscription plans take effect at the next billing cycle unless otherwise specified by the App Store.

4. Refund Policy

  • App Store Purchases: Refunds for subscriptions or in-app purchases are handled directly by the Apple App Store or Google Play Store, in accordance with their respective refund policies.
  • Refund Eligibility: We cannot process refunds directly for App Store transactions. You may request a refund via your App Store account (Apple: reportaproblem.apple.com, Google Play: play.google.com).
  • Exceptional Circumstances: In cases of technical issues or accidental purchases, we may assist you with submitting a refund request to the relevant App Store.

5. Payment Issues

If a payment fails due to insufficient funds, expired payment method, or other issues, your subscription may be suspended or downgraded to the free version until the payment is successfully processed.

6. Pricing and Changes

  • We reserve the right to modify subscription prices or introduce new subscription tiers. If prices change, you will be notified in advance through the App Store.
  • Continued use of the subscription after the change in pricing becomes effective constitutes your agreement to the new price.

7. Account Termination

  • We reserve the right to suspend or terminate your account for violation of our Terms and Conditions, this Policy, or applicable laws.
  • Upon termination, you will no longer have access to subscription features. No refunds are issued for accounts terminated due to policy violations.
